PRIVACY POLICY
1. By submitting personal data via the online contact form, the user confirms that they are familiar with the terms and conditions of personal data protection, that they express their consent to their wording, and that they fully accept them.
2. The provider is the company PROMO HALY s.r.o., with its registered office at Moravská 2864/63, ZIP code 767 01 Kroměříž, Company ID: 14363127, and is the controller of users' personal data according to Art. 4 point 7) of Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) (hereinafter referred to as “GDPR”). The provider undertakes to process personal data in accordance with legal regulations, especially the GDPR.
3. Personal data means any information relating to an identified or identifiable natural person; an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, identification number, location data, online identifier, or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural, or social identity of that natural person.
4. When contacting via the contact form, personal data necessary for the successful processing of the inquiry are required (first name, last name, e-mail, telephone, and IP address). The purpose of processing personal data is to process and specify the user's inquiry and to exercise rights and obligations arising from the contractual relationship between the Provider and the User. The purpose of processing personal data also includes sending commercial communications and conducting other marketing activities. The legal basis for processing personal data is the performance of a contract pursuant to Art. 6(1)(b) GDPR, compliance with a legal obligation of the controller pursuant to Art. 6(1)(c) GDPR, and the legitimate interest of the Provider pursuant to Art. 6(1)(f) GDPR. The legitimate interest of the Provider is the processing of personal data for direct marketing purposes.
5. The Provider uses the services of subcontractors, in particular providers of mailing services (personal data are stored within the EU or in third countries), web hosting providers, external programmers, external graphic designers, marketing specialists, providers of analytical services, and providers of marketing services. Subcontractors are vetted for secure processing of personal data. The Provider and the web hosting subcontractor have concluded a data processing agreement, under which the subcontractor is responsible for the proper security of the physical, hardware, and software perimeter, and thus bears direct responsibility to the user for any leakage or breach of personal data.
6. The Provider stores the user's personal data for the period necessary to exercise rights and obligations arising from the contractual relationship between the provider and the user and to assert claims from these contractual relationships (for a period of 15 years from the termination of the contractual relationship). After this period, the data will be deleted.
7. The user has the right to request access to their personal data from the provider pursuant to Art. 15 GDPR, rectification of personal data pursuant to Art. 16 GDPR, or restriction of processing pursuant to Art. 18 GDPR. The user has the right to erasure of personal data pursuant to Art. 17(1)(a), and (c) to (f) GDPR. Furthermore, the user has the right to object to processing pursuant to Art. 21 GDPR and the right to data portability pursuant to Art. 20 GDPR. 8. The user has the right to lodge a complaint with the Office for Personal Data Protection if they believe that their right to personal data protection has been violated.
9. The user is not obliged to provide personal data. However, the provision of personal data is a necessary requirement for processing the inquiry, and without providing personal data, it is not possible to process the inquiry.
10. The Provider does not carry out automated individual decision-making within the meaning of Art. 22 GDPR.
11. By filling in the contact form, the applicant for the Provider's services:
11.1. agrees to the use of their personal data for the purposes of electronic sending of commercial communications, advertising materials, direct sales, market research, and direct offers of products by the Provider and third parties, but not more frequently than once a week, and at the same time
11.2. declares that the sending of information pursuant to point 11.1 is not considered unsolicited advertising within the meaning of Act No. 40/1995 Coll., as amended, since the user expressly agrees to the sending of information pursuant to point 11.1 in connection with § 7 of Act No. 480/2004 Coll.
11.3. The consent under this paragraph may be withdrawn by the user at any time in writing at faktury@promohaly.cz
12. As part of improving the quality of services, personalizing offers, collecting anonymous data, and for analytical purposes, the Provider uses so-called cookies on its website. By using the website, the User agrees to the use of this technology.
In accordance with Act No. 101/2000 Coll. and with regard to Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of personal data, the data subject consents to the processing of their personal data provided to the data controller.
